We don't wish to turn you off submitting your blog, orchid information or image (the “Content”) by immediately inundating you with legalese, but we do need to make clear our respective rights and responsibilities related to this service. Orchids Online Web Design (“Orchids Online”) offer these blogging, orchid information and image display services (the “Services”) to you subject to the terms and conditions of use (the “Terms”) contained herein. By accessing, creating or contributing to any Services hosted at http://www.orchidsonline.com.au/, and in consideration for the Services we provide to you, you agree to abide by these Terms. Please read them carefully before posting to or creating any Content using our Sevices.

1. Rights in the Content You Submit

Unless you specify otherwise, any and all works of authorship copyrightable by you and posted by you to any of our Content types metioned above are submitted under the terms setout herein. Under these Terms, you agree you permit anyone to copy, distribute and display your Content, royalty-free, on the condition that they credit your authorship each time they do so. You also permit others to distribute derivative works of your Content.
 
Amongst other things, this license permits RSS aggregators to copy, distribute, display any Content that you submit here ("Syndicate") using RSS. You need to know that All Content which you submit becomes Syndicated for RSS aggregation.

When publicly displaying, reproducing or distributing copies of your Content, or Content as incorporated into a collective work, Orchids Online will make best efforts to credit your authorship. You grant Orchids Online permission to use your name (or at minimum your username) for such attribution purposes. You, likewise, agree to represent yourself accurately. You acknowledge that misrepresentation or other abuse may lead us, in our sole discretion, to cancel or limit your use of the Services and either delete or remove your access to any of your freely submitted Content.

2. Conduct

Those of us who are moderating this project believe deeply in free speech and are aiming to build a discussion area and a reference which may become of some use to those interested in furthering the enjoyment of and general knowledge of orchids worldwide. Given our role in offering this service and our presence together as part of the extended orchid internet community, however, we must reserve the right to remove certain content that you may post.

As a general matter, you may post content freely and are free to make comment on content submitted by others, so long as the content or comment is not illegal, obscene, defamatory, threatening, infringing of intellectual property rights, invasive of privacy or otherwise injurious or objectionable.

Orchids Online reserves the right to make alterations to submissions where the name of a plant proves to be a synonym of an accepted name or is incorrect. The resource we use to check all names for current status is Royal Botanic Gardens, Kew: World Checklist. We would encourage you to also make use of this fantastic orchid resource. In all cases we will note any synonyms to the accepted name and also note the name originally used by you if it is different to both the above.

Orchids Online also reserves the right to make minor HTML adjustments to your content to enable the site to function or display correctly if necessary. We will try to have this done without changing the general 'feel or character' of your content but sometimes this will not be possible. We apologise in advance for this. If you disapprove of any changes please let us know and we will try to help you further.

You may not use the Orchids Online name to endorse or promote any product, opinion, cause or political candidate without the express permission of Orchids Online. Representation of your personal opinions as being endorsed by Orchids Online is strictly prohibited.

By posting content, you warrant and represent that you either own or otherwise control all of the rights to that content, including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the content, or that your use of the content is a protected fair use. You agree that you will not knowingly and with intent to defraud provide material and misleading false information. You represent and warrant also that the content you supply does not violate these Terms, and that you will indemnify and hold Orchids Online harmless for any and all claims resulting from content you supply.

You acknowledge that Orchids Online does have the right to review posted content. You acknowledge that Orchids Online does have the right to remove in its sole discretion any content that it considers to violate these Terms.

Orchids Online also reserves the right to limit or remove access to the site to users who have in its opinion violated the Terms set out in this document. Any content previously submitted by such limited access users may or may not be removed from the site by the Orchids Online team. This decision will be made based purely on the merit of the content and no further discussion will be entered into.

Accessing

You understand that all content posted to http://www.orchidsonline.com.au/ is the sole responsibility of the individual who originally posted the content. You understand, also, that all opinions expressed by users of this site are expressed strictly in their individual capacities, and not as representatives of Orchids Online.

You agree that Orchids Online will not be liable, under any circumstances and in any way, for any errors or omissions, loss or damage of any kind incurred as a result of use of any content posted on this site. To the full extent permissible by applicable law, Orchids Online hereby disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for any particular purpose. Orchids Online will not be liable for any damages of any kind arising from the use of or inability to use this site. You expressly agree that you use this site solely at your own risk.
